Aggressive Washington Privacy Law Includes Right to Sue and Onerous Consent Obligations
Privacy & Data Security Associate Bram Schumer is quoted in the article, "Aggressive Washington Privacy Law Includes Right to Sue and Onerous Consent Obligations" published by Cybersecurity Law Report. The article discusses the Washington state privacy law referred to as, My Health My Data (MHMD) that is the first U.S. privacy law in the 2020s to give consumers an unrestricted right to sue. Bram is quoted saying, "MHMD categorizes cookie identifiers and IP addresses as personal information. The FTC took a similar position in the GoodRx and BetterHelp settlements."
The FTC found that the apps’ providing Facebook and Instagram with cookie data and consumer’s browsing behavior for prescriptions and health conditions enclosed personal health information. Bram notes, “This data can be used to show consumers targeted advertisements for things like STI testing and mental health services."
