Mylan’s Kirkland Ellis Suit May Hold Clues for Conflict Waivers
Law360 quoted Nicole Hyland on what Mylan Inc. et al. v. Kirkland Ellis LLP could mean for conflict waivers. In the suit, Mylan alleged Kirkland & Ellis LLP breached fiduciary, ethical and professional duties when it agreed to represent Mylan’s rival, Teva.
The article (which is behind a paywall) quoted Ms. Hyland saying, "Most case law on waivers and conflicts of interest is within a litigation, and there just isn't a lot of guidance about how these rules apply outside of that. The fact that Mylan is a current Kirkland client is also notable with the typical waiver challenge coming from a firm's former client."
